1. DEFINIZIONE E OGGETTO DEL CONTRATTO
1.1 - Il presente contratto ("Contratto") è un contratto a distanza ai sensi dell'art. 50 e ss. Del D.Lgs. 6 settembre 2005, n. 206 ("Codice del Consumo"). Il Contratto ha per oggetto la vendita di beni mobili tra un negozio Armonie d’Epoca di Massimo Ubaldi gestito da Massimo Ubaldi, con sede legale in Via C. Colombo 21/c 05100 Terni e il consumatore (il "Cliente"). Il Contratto è concluso direttamente attraverso l'accettazione da parte di Armonie d’Epoca di una proposta di acquisto emessa da parte del Cliente per via telefonica o tramite internet, nel sito web www.armoniedepoca.it (il "Sito") e/o attraverso altri sistemi di vendita a distanza di ARMONIE D’EPOCA, sulla base delle modalità descritte al successivo articolo 3. 
1.2 Le presenti condizioni generali di vendita ("Condizioni Generali") e, in particolare, le informazioni di cui all'art. 52 del Codice del Consumo, così come fornite da ARMONIE D’EPOCA, ripetute al telefono al Cliente e riportate nel Sito, rimarranno valide ed efficaci finché non saranno modificate e/o integrate da ARMONIE D’EPOCA. Eventuali modifiche e/o integrazioni alle Condizioni Generali saranno efficaci con decorrenza dalla data in cui saranno comunicate al pubblico e si applicheranno alle vendite effettuate a decorrere da detta data. L'ultima versione aggiornata delle Condizioni Generali è quella reperibile sul Sito.


2. PREZZI
I prezzi di vendita dei prodotti illustrati sul Sito e/o attraverso eventuali altri sistemi di vendita a distanza di ARMONIE D’EPOCA sono comprensivi di I.V.A. e di ogni altra imposta. Le spese di consegna sono indicate sul Sito e/o attraverso eventuali altri sistemi di vendita a distanza di ARMONIE D’EPOCA e, nel caso di ordine telefonico, ripetute al Cliente dall'operatore ARMONIE D’EPOCA.
Tutti i dati pubblicati negli annunci si intendono validi, salvo errori ed omissioni di trascrizione, nel titolo, nel prezzo, nella descrizione o nella foto


3. MODALITA' DI ACQUISTO E DI PAGAMENTO
3.1 - Il Contratto per via telefonica si perfeziona mediante la comunicazione al Cliente (che abbia contattato telefonicamente ARMONIE D’EPOCA e formulato, in tale occasione, una proposta d'acquisto fornendo altresì all'operatore i dati necessari per la procedura di registrazione del proprio nominativo, dell'ordine di acquisto e della modalità di pagamento scelta) che la proposta è accettata.
3.2 - In caso di proposte d'acquisto inviate tramite il Sito il Cliente riceverà da ARMONIE D’EPOCA una e-mail riepilogativa, con cui sarà informato che la propria proposta d'acquisto è in fase di elaborazione e si intenderà accettata, salvo contraria comunicazione e-mail o telefonica trasmessa da ARMONIE D’EPOCA entro il termine di 3 (tre) giorni di calendario dal ricevimento della e-mail riepilogativa. Decorso tale termine, il Contratto a mezzo internet è da intendersi perfezionato. 
3.3 - Al Cliente sarà consentito scegliere una delle seguenti modalità di pagamento:

• Bonifico Bancario
• Ricarica Poste Pay
• Pay Pal
• qualunque mezzo di pagamento di volta in volta indicato come valido da ARMONIE D’EPOCA sul Sito.

4. CONSEGNA DEI PRODOTTI - RECLAMI
4.1 – ARMONIE D’EPOCA consegna i prodotti all'indirizzo indicato dal Cliente.
4.2 - Qualsiasi reclamo inerente l’acquisto di un prodotto potrà essere inoltrato all’ indirizzo di riferimento presente nella descrizione dell’oggetto venduto.

5. DISPONIBILITÀ DEI PRODOTTI
ARMONIE D’EPOCA accetta gli ordini del Cliente nei limiti delle quantità dei prodotti richiesti esistenti in magazzino. Pertanto, l'accettazione da parte di ARMONIE D’EPOCA della proposta d'acquisto inoltrata dal Cliente è subordinata alla disponibilità a magazzino dei prodotti stessi. ARMONIE D’EPOCA si impegna a comunicare tempestivamente al Cliente eventuali imprevedibili esaurimenti di scorte dovuti ad eccesso di domanda o altre cause.


6. GARANZIE E ASSISTENZA
Per i prodotti acquistati dal Cliente sono applicabili a ARMONIE D’EPOCA le norme in materia di garanzie e assistenza relativamente alla vendita di beni di consumo.


7. OBBLIGHI DEL CLIENTE
Il Cliente dichiara e garantisce: di essere un consumatore secondo quanto previsto all'art. 3 del Codice del Consumo; di essere maggiorenne; che i dati dallo stesso forniti per l'esecuzione del Contratto sono corretti e veritieri.


8. DIRITTO DI RECESSO
8.1 - La vendita è assistita dalle garanzie per vizi e difetti previsti dalla legge. Ai sensi dell’art 53 D. Lgs 6 Settembre 2005 n° 206, se il Cliente è un consumatore ha diritto di recedere dal contratto di acquisto per qualsiasi motivo e senza fornire spiegazioni. Per esercitare tale diritto, il cliente dovrà inviare una comunicazione scritta entro 14 giorni lavorativi dalla data di ricevimento della merce. La comunicazione dovrà essere indirizzata, previo avvertimento, via mail al negozio dal quale si è eseguito l’acquisto. La merce dovrà poi essere restituita a cura e spese del Cliente entro 14 giorni dalla data di ricevimento della merce stessa, al negozio dal quale si è eseguito l’acquisto. Si provvederà alla restituzione dell’intero importo pagato (escluse le spese di spedizione) dopo aver accertato l’integrità della merce. Per conferma scritta di tutte le condizioni contrattuali nonché delle ulteriori informazioni di cui all’art. 53 D. Lgs 206/2005. LEGGI IL DECRETO LEGISLATIVO. 
8.2 - Il Cliente che intende avvalersi del diritto di recesso dovrà restituire i prodotti all'indirizzo indicato nella descrizione dell’oggetto acquistato, entro 14 giorni dal ricevimento dei prodotti. Ai sensi dell'articolo 55, secondo comma, del Codice del Consumo, il Cliente non avrà diritto di recesso nei seguenti casi
- fornitura di prodotti audiovisivi o di software sigillati, aperti dal Cliente;
- fornitura di prodotti confezionati su misura o personalizzati, o che per loro stessa natura, non possono essere rispediti o rischiano di deteriorarsi o alterarsi rapidamente (es. cosmetici, fiori, generi alimentari);
- fornitura di giornali, periodici e riviste.
8.3 - Le spese di restituzione dei prodotti sono a carico del Cliente. ARMONIE D’EPOCA restituirà, entro 14 giorni dalla data di ricevimento dei prodotti da parte del Cliente: l'intero prezzo pagato dal Cliente in caso di restituzione del prodotto completo di tutte le sue parti e funzionalità; ovvero la parte del prezzo equivalente al prodotto effettivamente restituito dal Cliente che abbia consumato il prodotto in maniera apprezzabile e/o tale da sminuirne significativamente il valore.


9. TRATTAMENTO E RISERVATEZZA DEI DATI PERSONALI INFORMATIVA AI SENSI DEL D.LGS. 196/03
9.1 Ai sensi e per gli effetti di quanto disposto dal D.Lgs del 30 giugno 2003, n.196 Codice in materia di protezione dei dati personali (di seguito il "Codice"), Vi informiamo che i Vostri dati personali, forniti e/o acquisiti successivamente, verranno trattati da ARMONIE D’EPOCA, in Italia e all'estero, attraverso strumenti elettronici e manuali nel rispetto del Codice e della normativa vigente in materia di privacy.
Finalità del trattamento

I dati raccolti vengono trattati per le seguenti finalità: a. iscriversi al servizio; b. concludere contratti di compravendita e realizzarne la prestazione; c. effettuare gli adempimenti necessari a dare esecuzione al rapporto contrattuale posto in essere; d. inviare informazioni commerciali, materiale pubblicitario, informativo e promozionale, con ogni mezzo (e-mail, sms, ecc); e. effettuare, anche mediante contatto telefonico, ricerche di mercato, analisi economiche e statistiche al fine di verificare il corretto funzionamento dei servizi e il gradimento degli stessi; f. elaborare informazioni personalizzate circa l'abitudine di consumo e l'orientamento degli interessati; g. comunicare i dati a società terze per finalità di direct marketing. Il conferimento dei dati è obbligatorio per la conclusione del contratto d'acquisto, facoltativo negli altri casi. Il mancato conferimento dei dati comporterà l'impossibilità di poter eseguire l'ordine effettuato.
Conservazione dei dati

Tutti i dati acquisiti non potranno essere utilizzati per altre finalità oltre a quelle suindicate e verranno conservati per il periodo necessario alla realizzazione delle medesime. Trascorso tale termine, i dati verranno cancellati o trasformati in forma anonima. Per i dati di dettaglio su acquisti e servizi, i tempi di conservazione non saranno superiori a quelli stabiliti dalla normativa vigente.
Diritti dell'interessato

Resta salva la Vostra facoltà di esercitare in ogni momento i diritti di cui all'art.7 (Diritto di accesso ai dati personali e altri diritti) del Codice, in particolare: il diritto di accedere ai propri dati personali, chiederne la rettifica, l'aggiornamento e la cancellazione se incompleti, erronei o raccolti in violazione della normativa vigente, nonché di opporsi al loro trattamento per motivi legittimi, rivolgendo una richiesta scritta alla societò Armonie d’Epoca di Ubaldi Massimo, via C.Colombo 21/c - 05100 Terni, ovvero direttamente attraverso le modalità indicate nel sito nella pagina di accesso ai dati.

10. FORO COMPETENTE
Il Contratto è regolato dalla legge italiana. Ogni controversia relativa all'applicazione, esecuzione, interpretazione e violazione del Contratto sarà di competenza del Foro in cui il Cliente ha la propria residenza o domicilio, se ubicati nel territorio dello Stato italiano, o del Foro di Terni, qualora il Cliente abbia la propria residenza o il proprio domicilio all'estero.

1. DEFINITION AND SUBJECT MATTER OF THE CONTRACT
1.1 - This contract ("Contract") is a distance contract pursuant to art. 50 and ss. Del D.Lgs. 6 September 2005, n. 206 ("Consumer Code"). The object of the Contract is the sale of mobile goods between a Armonie d'Epoca store of Massimo Ubaldi managed by Massimo Ubaldi, with registered office in Via C. Colombo 21/c 05100 Terni and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Armonie d'Epoca
of a purchase proposal issued by the Customer by telephone or via the internet, on the website www.armoniedepoca.it (the "Site") and/or through other distance selling systems of ARMONIE D'EPOCA, on the basis of the methods described in article 3.  1.2 These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by ARMONIE D'EPOCA, repeated over the phone to the Customer and reported on the Site, will remain valid and effective until they are modified and/or supplemented by ARMONIE D'EPOCA. Any amendments and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is the one available on the Site.


2. PRICES
The sales prices of the products shown on the Site and/or through any other distance selling systems of ARMONIE D'EPOCA are inclusive of I.V.A. and any other taxes. The delivery costs are indicated on the Site and/or through any other distance selling systems of ARMONIE D'EPOCA and, in the case of telephone orders, repeated to the Customer by the operator ARMONIE D'EPOCA.
All data published in the advertisements are valid, except errors and omissions of transcription, in the title, price, description or photo

3. METOD OF PURCHASE AND PAYMENT
3.1 - The Contract by telephone is concluded by communication to the Customer
(who contacted ARMONIE D'EPOCA
by telephone and made, on that occasion, a purchase proposal also providing the operator with the necessary data for the registration procedure of his name, the purchase order and the payment method chosen) that the proposal is accepted. 3.2 - In case of purchase proposals sent through the Site, the Customer will receive from ARMONIE D'EPOCA a summary e-mail, with which he will be informed that his purchase proposal is being processed and will be accepted, unless otherwise communicated and-mail or telephone transmitted by ARMONIE D'EPOCA within the deadline of 3 (three) calendar days from receipt of the summary email. After this period, the Internet Contract shall be considered completed.  3.3 - The Customer will be allowed to choose one of the following payment methods:
Bank transfer
Recharge Poste Pay
Pay Pal
any means of payment from time to time indicated as valid by ARMONIE D'EPOCA on the Site.

4. DELIVERY OF PRODUCTS - COMPLAINTS
4.1 - ARMONIE D'EPOCA delivers the products to the address indicated by the Customer
. 4.2 - Any claim relating to the purchase of a product may be made to the reference address in the description of the item sold.

5. AVAILABILITY OF PRODUCTS
ARMONIE D'EPOCA accepts the Customer’s orders within the limits of the quantities of the products in stock. Therefore, the acceptance by ARMONIE D'EPOCA of the purchase proposal submitted by the customer is subject to the availability in stock of the products themselves. ARMONIE D'EPOCA undertakes to promptly notify the Customer of any unforeseeable outages due to excess demand or other causes.


6. GUARANTEES AND ASSISTANCE
For products purchased by the Customer, the rules on guarantees and assistance regarding the sale of consumer goods are applicable to ARMONIE D'EPOCA.


7. OBLIGATIONS OF THE CUSTOMER
The Customer declares and guarantees: to be a consumer in accordance with art. 3 of the Consumer Code; to be of age; that the data provided by the same for the execution of the Contract are correct and truthful.


8. RIGHT OF WITHDRAWAL
8.1 - The sale is backed by the guarantees for defects and defects provided by law. Pursuant to Article 53 D. Lgs 6 September 2005 n. 206, if the customer is a consumer has the right to withdraw from the purchase contract for any reason and without providing explanations. To exercise this right, the customer must send a written notice within 14 working days from the date of receipt of the goods. The communication must be addressed, after warning, via email to the store from which the purchase was made. The goods must then be returned by the Customer within 14 days from the date of receipt of the goods, to the store from which the purchase was made. The entire amount paid (excluding shipping costs) will be returned after checking the integrity of the goods. - The Customer who intends to exercise the right of withdrawal must return the products to the address indicated in the description of the purchased item, within 14 days of receipt of the products. Pursuant to the second paragraph of Article 55 of the Consumer Code, the Customer will not have the right of withdrawal in the following cases
supply of audiovisual products or sealed software opened by the Customer;
supply of made-to-measure or personalised products, or products which by their very nature cannot be returned or are likely to deteriorate or become rapidly altered (e.g. cosmetics, flowers, foodstuffs);
provision of newspapers, periodicals and magazines.
8.3 - The cost of returning the products shall be borne by the Customer. ARMONIE D'EPOCA will return, within 14 days from the date of receipt of the products by the Customer: the full price paid by the Customer in case of return of the product complete with all its parts and functionality; or the part of the price equivalent to the product actually returned by the Customer that has consumed the product in an appreciable manner and/ or such as to significantly reduce its value.


9. PROCESSING AND CONFIDENTIALITY OF PERSONAL DATA IN ACCORDANCE WITH LEGISLATIVE DECREE 196/03. PRIVACY POLICY
9.1 Pursuant to and for the purposes of the provisions of Legislative Decree of 30 June 2003, n.196 Code on the protection of personal data (hereinafter the "Code"), we inform you that your personal data, provided and/or acquired subsequently, will be processed by ARMONIE D'EPOCA, in Italy and abroad, through electronic and manual tools in compliance with the Code and current legislation on privacy.
Purpose of processing
The data
collected are processed for the following purposes: a. subscribe to the service; b. conclude contracts of sale and perform the services; c. carry out the obligations necessary to fulfil the contractual relationship; d. send commercial information, advertising, informative and promotional material, by any means (e-mail, sms, etc.); and. to carry out, including by telephone contact, market research, economic and statistical analyses in order to verify the correct functioning of the services and their acceptance; f. develop personalised information about the consumption habits and the orientation of those concerned; g. communicate data to third parties for direct marketing purposes. The provision of data is mandatory for the conclusion of the purchase contract, optional in other cases. Failure to provide data will make it impossible to execute the order made.
Retention of data

All data acquired may not be used for other purposes than those mentioned above and will be kept for the period necessary for the realization of the same. After this period, the data will be deleted or transformed into anonymous form. For detailed data on purchases and services, the retention time will not exceed those established by current legislation.
Rights of

the data subject Your right to exercise at any time the rights referred to in art.7 (Right of access to personal data and other rights) of the Code, in particular: the right to access your personal data, ask for its rectification, updating and cancellation if incomplete, erroneous or collected in violation of current legislation, as well as opposing their processing for legitimate reasons, by sending a written request to the company Armonie d'Epoca di Ubaldi Massimo, via C.Colombo 21/c - 05100 Terni, or directly through the methods indicated in the site on the page of access to data.

10. COMPETENT COURT
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract will be the responsibility of the Court in which the Customer has his residence or domicile, if located in the territory of the Italian State, or the Court of Terni, if the customer has his residence or domicile abroad.
